MEMBERSHIP AGREEMENT
Gallery Philosophy & Mutual Expectations
Harbor City Art is a curated membership gallery committed to fostering creativity, connection, and community among its members. We believe the gallery is a space for visibility, inspiration, and engagement—not solely a place for immediate sales. While we actively promote the work of our artists and welcome sales as a positive outcome, our deeper mission is to build a thriving, supportive creative community of artists. We invite you to join us in building the kind of creative space we all want to be part of—one that celebrates the artist, honors the work and welcomes others to share in the joy of creativity!
What You Can Expect from the Gallery:
A clean, well-maintained, and thoughtfully curated space to showcase your work
Regular promotion through gallery-hosted events, social media, and newsletters
Respectful communication, fair and transparent display fees and commission structure, and timely payouts
A welcoming atmosphere where you can connect with a supportive community of local artists and makers
What We Ask of Participating Artists:
To help sustain and grow the gallery, we ask that artists:
Promote their participation in the gallery by sharing posts, events, and class listings on social media
Attend artist events and gallery socials when possible
Keep their display space updated and well-stocked with gallery quality work
Treat fellow artists, staff, and guests with courtesy and respect
Represent the gallery positively in conversations, online, and in the community
Membership Fee & Space Allocation
A membership fee of $______________ per month will be charged for displaying the Artist’s work.

This fee is non-refundable and covers promotional, administrative, and operational costs of the Gallery.
Membership fee invoices will be emailed on the 1st of each month. Payment is due by the 10th of the month. Payments received after the 10th may be subject to a 10% late fee. We appreciate your timely payment, which helps us keep the gallery running smoothly and support all participating artists.
Failure to pay the membership fee will result in removal of the Artist's work from display. Harbor City Art will store removed artwork for up to 30 days after written notice of non-payment or breach of agreement. If the artist does not retrieve their items by the deadline provided, the items will be considered abandoned and may be donated, discarded, or otherwise disposed of at the gallery’s discretion.
Sales & Commission
The Gallery will retain 20% of the retail price of each sale as commission. The Artist will receive 80% of the retail price.
The Gallery will process all sales transactions and collect and remit applicable sales tax.
Payments to the Artist for sold items will be issued by check by the 5th day of the following month.
Artists participate in gallery sales on a consignment basis and are considered self-employed and responsible for reporting their own income. 1099s will not be issued for sales proceeds paid to artists for consigned artwork.
Gallery Hanging Standards
All wall-hung artwork must arrive wired and ready for hanging using D-rings and picture wire only—no sawtooth hangers, cleats, keyhole slots, or clip frames. Wire must be securely attached no more than one-third from the top and must support the full weight of the piece.
Works on paper must be matted and framed under glass or acrylic. Frames must be clean, secure, and in good repair with no visible chips or cracks.
Gallery-wrapped canvases must have finished or painted edges with no visible staples or hardware.
Matted prints and cards must be sleeved in clear protective envelopes for display in bins, racks, or shelves.
Uniform wall labels will be provided by the Gallery. All wall-hung artwork must be tagged with approved wall labels.
Harbor City Art uses a gallery hanging system with steel cables and tracks. The following weight and hanging limits must be adhered to:
Single hook on one cable: Maximum 44 lbs.; Two hooks on two cables: Maximum 88 lbs.;
Multiple artworks on one cable: Maximum 66 lbs. per cable;
Track weight limit: Maximum 130 lbs. per 6.5-foot section or 60 lbs. per 3-foot section.
Shelf Display Standards
Harbor City Art will provide all shelving for gallery displays.
Shelf space is for approved display items only and may not be used for storage of packaging, tools, personal belongings, or unapproved products.
All items must be clean, finished, and gallery-ready.
All shelf items must be stable and freestanding. If a display stand or base is required, it must be provided by the Artist.
All shelf items must be tagged with plain white price tags indicating the artist, item description, and price.
Curation & Display Authority
While input from Artists is welcome, the Gallery will curate all displays to ensure visual cohesion, safety, and alignment with the Gallery’s mission and style.
The Gallery reserves the right to make all final decisions regarding the placement, presentation, and duration of displayed work. The Gallery may rotate, relocate or remove items at its discretion.
Use of Images for Marketing & Promotion
The Artist grants the Gallery a non-exclusive, royalty-free right to photograph and use images of the Artist’s displayed artwork for the purposes of marketing and promoting both the Gallery and the Artist. This includes, but is not limited to, use on the Gallery’s website, social media accounts, printed materials, press releases, advertisements, and other promotional outlets.
Whenever reasonably possible, the Gallery will credit the Artist when an image of their work is used. The Artist retains all copyright ownership of their work, and this provision does not transfer any rights of ownership or copyright to the Gallery.
The Artist acknowledges and agrees that no compensation beyond exhibition opportunities and potential sales will be provided for such promotional use.
Liability & Indemnification
The Artist indemnifies the Gallery against any claims related to copyright infringement, product liability, or damages caused by their work.
The Gallery is not responsible for loss or damage due to theft, natural disaster, or any other cause.
The Artist is responsible for insuring their own work if desired.
While input from Artists is welcome, the Gallery will curate all displays to ensure visual cohesion, safety, and alignment with the Gallery’s mission and style.

Duration & Termination
This Agreement shall continue on a month-to-month basis beginning _________________________________ and until terminated by either Party with 30 days’ written notice.
Upon termination, the Artist must remove all items by the end of the final display month.
If not removed, the Gallery reserves the right to dispose of or store items at the Artist’s expense.
Miscellaneous
Any amendments to this Agreement must be in writing and signed by both Parties.
This Agreement is governed by the laws of the State of Florida.
Any disputes shall be resolved through mediation or arbitration prior to litigation.
